1. Definitions
- Entrepreneur: Northern Muse
- Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a Distance Agreement with Northern Muse;
- Items: the clothing, accessories and (vintage) bags that are offered for purchases on the Website;
- Right of withdrawal: the option for the Consumer to cancel the Distance. Agreement within cancellation period;
- Distance Agreement: an Distance Agreement concluded within the framework of a sales system organized by Northern Muse for the remote sale of Items, whereby exclusively means of distance communication, such as the website and the internet, are used throughout the entire process up to and including the formation of the agreement;
- Webshop: the online shop operated by Northern Muse through the Website;
- Website: www.northern-muse.com
2. Applicability
These terms and conditions apply to all offers, orders, and agreements with Consumers purchasing Items via the Webshop. By placing an order, the Consumer accepts these terms. Any deviations are only valid if agreed in writing.
3. Offer and product information
Items are imported from Asia, America, and Europe. The offer on the Webshop contains the clearest and most complete description possible of the Items offered. In the case of vintage and pre-owned Items, any visible signs of use or wear are described as accurately as reasonably possible. Northern Muse cannot be held to the content of its offers if the Consumer can reasonably understand that the offer, or any part thereof, contains an obvious mistake or typographical error. Northern Muse is not liable for any damage resulting from such an obvious mistake or typographical error.
4. The Distance Agreement
The Distance Agreement is concluded at the moment the Consumer places an order and receives an electronic order confirmation. Northern Muse reserves the right to refuse an order in the event of fraud, payment issues, obvious errors, or if there is reasonable suspicion of any of these.
5. The price and payment
All prices are stated in euros, including VAT and excluding shipping costs, unless otherwise indicated. Payment must be made using the payment methods offered on the Website. Delivery of the order will commence only after payment has been received. The Consumer is obliged to immediately notify Northern Muse of any incorrect payment information.
6. The delivery
Delivery takes place within Europe to the destination provided by the Consumer. Shipping is carried out by the carrier indicated on the Webshop. Shipping costs are clearly displayed before the completion of the order. Northern Muse dispatches Items within the delivery times stated on the website. If this is not possible, the Consumer will be informed in a timely manner. If the Consumer has not received any update regarding delivery within 14 business days, they must contact Northern Muse by email at info@northern-muse.com. If delivery is delayed by more than 20 business days, or if the order cannot be fulfilled or can only be partially fulfilled, the Consumer will be notified as soon as possible. In such cases, the Consumer has the right to terminate the Distance Agreement at no cost, and Northern Muse will refund the amount paid by the Consumer as soon as possible, but no later than 30 days after termination. Northern Muse reserves the right to ship an order in partial deliveries if necessary. Northern Muse will make every effort to resolve any delivery issues to the Consumer’s satisfaction. The risk of damage or loss of the Items rests with Northern Muse until the moment of delivery to the Consumer.
7. Right of Withdrawal
The Consumer has the right to withdraw from the Distance Agreement within 14 days of receiving the Item, without giving any reason. To exercise this right, the Consumer must notify Northern Muse of their decision to withdraw via email or the withdrawal form within this period. Following such notification, the Consumer has 14 business days to return the Item to Northern Muse. The Consumer is responsible for the return shipment and any associated costs, unless otherwise stated by Northern Muse. Products may only be returned if they are in their original condition. The Consumer may try on the Item, but it must not be worn or used beyond what is necessary to assess whether they wish to keep it. All original packaging, labels, tags, and accessories must be intact and attached. Items that appear to have been worn, used, or with removed tags or labels may be refused for return by Northern Muse. Northern Muse will refund the purchase price, including any standard shipping costs paid, within 14 business days after receipt of the returned Item.
8. Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to items that cannot be returned for hygiene reasons if the seal has been broken, and to Items that have been custom-made or specifically adapted for the Consumer.
9. Warranty
Northern Muse guarantees that the Items comply with the Distance Agreement and meet the Consumer’s reasonable expectations regarding quality and usability. The statutory warranty under European law and regulations applies. Normal wear and tear, damage resulting from improper use, or damage occurring after delivery are not covered by the warrant. Vintage items are sold as is. Signs of wear and use are not covered by the warranty, unless they have not been clearly indicated. All materials and fabrics used in the Items are clearly listed on the Website. It is the responsibility of the Consumer to check for any substances to which they may be allergic and/or have an allergic reaction.
10. Complaints
Complaints must be submitted in full and clearly described within a reasonable period via Northern Muse’s contact form or email. Northern Muse will respond within 14 days of receiving the complaint. If the complaint cannot be resolved with Northern Muse, the Consumer may contact the European Consumer Centre (ECC).
11. Liability
Northern Muse is not liable for any indirect or consequential damages, unless such damages result from intentional misconduct or gross negligence on the part of Northern Muse. In any case, liability for indirect or consequential damages is limited to a maximum of €1,000. The total liability of Northern Muse for any direct damages arising from the Agreement is limited to the amount paid by the Consumer for the relevant Item. In the event of direct damages, such as defects or non-conformity of the purchased Item, the Consumer is entitled to compensation in the form of either a replacement Item or a refund of the purchase price of the affected item, with the specific form of compensation to be agreed upon between Northern Muse and the Consumer via email. The liability of Northern Muse ceases once the Consumer has paid the purchase price and the 14-day withdrawal period as described in these Terms and Conditions has expired, except in cases of intentional misconduct or gross negligence.
12. Force Majeure
In the event of force majeure, Northern Muse may suspend or cancel the Agreement without any obligation to pay compensation. Force majeure includes, but is not limited to, situations such as government intervention, fire in the warehouse, extreme weather conditions, lightning strikes, armed conflicts, and other similar unforeseen events beyond the control of Northern Muse.
13. Intellectual Property
All photos, texts, and designs on the website are the property of Northern Muse and may not be used without prior permission of Northern Muse.
14. Data Protection
Northern Muse processes personal data in accordance with the General Data Protection Regulation (GDPR). The Privacy Policy is available on the website.
15. Governing Law and Dispute Resolution
These Terms and Conditions are governed by Dutch law, without prejudice to the mandatory consumer protection laws applicable in the consumer’s country of residence within the European Union. Any disputes arising from the Distance Agreement between Northern Muse and the Consumer shall, unless mandatory law provides otherwise, be submitted to the competent court in the Netherlands. Northern Muse will make every effort to resolve any complaints amicably and promptly, in accordance with applicable European consumer protection laws.
16. Severability
If any provision of these Terms and Conditions is found to be invalid, unenforceable, or void, this shall not affect the validity of the remaining provisions. The affected provision shall be deemed replaced by a new provision determined by Northern Muse that is legally permissible and as close as possible in intent and effect to the original provision.
